Title of the public consultation: Green Paper Towards Cleaner Vehicles on our Roads

1. BACKGROUND
A Green Paper on the use of cleaner vehicles on our roads was drafted intended to invite feedback from stakeholders and public in general regarding the announced ICE cut-off date.
In 2019, the Cleaner Vehicles Commission (CVC) was set up with the objective to propose a date by when new registrations of passenger cars and small vans that are not zero or low emission might not be permitted. Subsequently, between 2019 and 2020, the CVC held a number of consultations with different stakeholders that ranged from Government entities, to the vehicle related industry and users, to representatives of economic, social and civil society. Furthermore, two studies have been commissioned to provide an analysis on potential cut-off dates and their impacts thereto.
In the case of Malta, a cut-off date might mean that it will not be possible to register the following type of new vehicles, unless they are not a zero or low emission vehicle:-
L4 (motor-vehicles with less than 4-wheels);
M15 (vehicles used for carriage of passengers comprising not more than 8 seats in addition to the driver);
N16 (vehicles used for carriage of goods and having a maximum mass not exceeding 3.5 tons)
The following are being put forward to discuss further:
1. Charging Points – accessibility of charging points and charging infrastructure.
2. Air Quality – environmental issues in our localities are linked to air pollutant emissions.
3. Certified technical people – required skills with ZLEV technology in particular for panel beaters and mechanics.
4. Incentives and disincentives –Government launched incentives to promote the uptake of electric vehicles.
5. Cut-off date – This would give a clear path for the transformation of the road transport sector.
2. CONSULTATION
The Cleaner Vehicles Commission wishes to launch the second-round of broad public consultation and is inviting all interested parties to provide input to the most relevant questions presented in the Green Paper, according to their expertise.

Malta’s Low Carbon Development Strategy

1. BACKGROUND
In line with this, the EU has a long-term strategy to achieve climate neutrality by 2050, under which each Member State is required to plan and communicate a Low Carbon Development Strategy (LCDS or “Strategy”) out to 2050. The document being published for public consultation is Malta’s LCDS, and has been prepared in line with the process outlined in the Regulation on the governance of the energy union and climate action (EU/2018/1999) , following the publication of the Low Carbon Development Vision (LCDV) in 2017. Government has already committed to becoming carbon neutral by 2050, as part of its five pillars of economic growth and recovery from the COVID-19 pandemic.
The LCDS is being spearheaded by the Ministry for the Environment, Climate Change and Planning (MECP), with considerable inter-ministerial collaboration involved. This Strategy is the result of a three-year process, whereby mitigation measures have been researched, possible abatement levels quantified through Marginal Abatement Cost Curve modelling (i.e. ratio of abatement potential against incremental cost of measure), and stakeholder consultation, leading to a list of realistic and cost-effective measures. The measures cover seven different sectors, namely: Energy, Transport, Buildings, Industry, Waste, Water and Agriculture and land-use, land-use change and forestry (LULUCF), aimed to achieve target reductions in greenhouse gas emissions by 2050 and also enabling Malta to reach its targets by 2030. In addition, it includes adaptation measures, proposing initiatives which will help the country be resilient in the face of Climate Change impacts which are already hitting our islands. The adaptation measures aim to address the specific risks and vulnerabilities which Malta faces given its nature as a small island state.

1. BACKGROUND
The Ministry for the
Environment, Climate Change and Planning has drafted the Long Term Renovation
Strategy emanating from the EU Energy Performance of Buildings Directive (EPBD)
(Directive (EU) 2018/844) which is a key part of the Clean Energy for all
Europeans policy package.
The EU has
identified the modernisation of its building stock as one of the key priorities
of the European Green Deal and is promoting a wide range of initiatives, such
as those identified by the Renovation Wave, to ensure Member States invest
sufficiently in their building stock. These initiatives, while supporting a
variety of objectives, are primarily aimed at making the EU building stock more
efficient and are a key driver in the transition to net zero by 2050.
The Malta Long Term
Renovation Strategy (LTRS) is a key planning document that sets out how the
Maltese Government aims to tackle this challenge and presents an overview of
the current situation and of the government new strategy.

This document provides:

overview of the national building stock addressing key areas such as energy
poverty and public buildings.
·
Indicative
milestones for 2030, 2040 and 2050.
·
Reviews
policies and actions implemented, and propose new ones to stimulate
cost-effective deep renovation of buildings.

initiatives to promote skills and education in the construction and energy efficiency
sectors, and
·
Gives
an estimate of expected energy savings and wider benefits.

Strategic Environmental Assessment Regulations (S.L. 549.61). The Screening

Initial Scoping Report for the SEA has been compiled and, on the basis of this
document, an Environmental Report will be prepared that will include an

1. BACKGROUND
As part of the 2020
Budget speech, the Government announced a new measure whereby the importation,
production, sale and distribution of certain single use plastic (SUP) items,
namely cutlery, straws and plates will be prohibited. More specifically, the
Government announced that the importation and production of such SUP items will
be prohibited as from 1st January 2021, whilst their selling and
distribution will be prohibited as from 1st January 2022.
In 2019, the EU
adopted the SUP Directive (Directive 2019/904), which aims at reducing the environmental
impact of certain SUP products and other plastic items on the environment, by
means of enacting a number of effective measures targeting the said products.
The Directive in question restricts the placement on the market of a number of
SUP items, including the above mentioned. The draft Restrictions on Placing on the
Market of Single-Use Plastic Products Regulations, 2020 implement part of the
said Budget measure whilst also transposing Article 5 and Article 6 (1) and 6
(2) of the SUP Directive.
Since these
regulations restrict the placement on the market of certain SUP products, they
will be enacted under both the Supplies and Services Act (Chapter 117 of the
Laws of Malta) and the Environment Protection Act (Chapter 549 of the Laws of
Malta) to ensure joint cooperation in enforcement of the proposed regulations
by Customs Department and the Environment and Resources Authority.
These
regulations prohibit the placement on the market of:
- The SUP items listed in Part A of the
Schedule and of products made from oxo-degradable plastic as from 1st
January 2021. Such SUP items include cutlery, straws, plates, cotton bud
sticks, beverage stirrers, balloon sticks as well as food or beverage
containers and cups made of expanded polystyrene;
- The SUP items listed in Part B of the
schedule as from 3rd July 2024. Such SUP items include plastic and
composite beverage containers with a capacity of up to three litres. Such
containers might be exempt from such prohibition if the plastic caps and lids
remain attached to the containers during their use.

1. BACKGROUND
As
part of the 2020 Budget speech, the Government announced a new measure whereby
the importation and production of plastic bags will be prohibited as from 1st
January 2021, whilst their selling and distribution will be prohibited as from
1st January 2022.
Article
4(1a) of Directive 94/62/EC on packaging and packaging waste requires that
Member States take appropriate measures to achieve a sustained reduction in the
annual consumption of lightweight plastic carrier bags. The Directive indicates
that those measures may include the use of marketing restrictions, provided
that these restrictions are proportionate and non-discriminatory.
The
draft Restrictions on Placing on the Market of Lightweight Plastic Carrier Bags
Regulations, 2020 implement
part of the said Budget measure while also bringing into effect the
aforementioned provisions of Directive 94/62/EC.
The
Regulations in question will be enacted under both the Supplies and Services
Act (Chapter 117 of the Laws of Malta) and the Environment Protection Act
(Chapter 549 of the Laws of Malta) to ensure joint cooperation in enforcement
of the regulations by the Customs Department and the Environment and Resources
Authority.
These Regulations will prohibit:
-
The importation,
intra-Community acquisition, and manufacturing for the circulation on the
market in Malta, in the course of a commercial activity, of any lightweight
plastic carrier bags as from 1st January 2021;
-
Any supply of
lightweight plastic carrier bags for distribution, consumption or use on the
market in Malta, in the course of a commercial activity as from 1st
January 2022.
Reusable plastic carrier bags, biodegradable and
compostable plastic carrier bags as well as very lightweight plastic carrier
bags are exempt from the above-mentioned prohibitions.

Background
The principal aim of the Majjistral Nature and History
Park Site (Amendment) Regulations is to provide further legal clarity with
respect to the practice of falconry within the Majjistral Park.
The proposed legal notice seeks to amend the Majjistral,
Nature and History Park Site Regulations (S.L. 549.83) hereafter, referred to
as the principal regulations in order to:

Amend the definition of the terms ‘hunt’ and
‘hunting’ of the principal regulations so as to ensure that such terms solely
encompass the hunting of game species through the use of a fire-arm or any
other weapon and do not include the hunting and taking of such species through
falconry;
·
Amend the definition of the terms ‘take’ and
‘taking’ to clarify that such definition covers the live-capture of both wild
birds and wild rabbit;
·
Introduce restrictions on the possession of
wild birds or wild rabbits (whether alive, dead or, parts of) outside the hours
when falconry is permitted.
